AGREEMENT TO CONTRACT

That you, the Lessor agrees, to abide by all the terms set out in the Terms and Conditions, and that we, Shamrock Car Hire, agree to provide a hire vehicle as described and at the cost mentioned herein.

Making a Booking

• In order to make a booking, we require a legible copy of your full valid driving licence, as well as your passport information, a full address where you will be staying in Spain, and a contact telephone number for you in Spain.
• We will send you a booking link, where you can record all of the information required, and submit your booking. When we request payment, we also require a fully refundable €250 excess. This deposit is to ensure the car is returned on time, on the correct day, and is complete with all of its equipment, and a full tank of fuel. The security deposit will then be refunded back in your account, normally within 2-3 days.
• If a booking is made within 10 days of your arrival, full payment will be required at the time of booking.
• For your security we will never ask for your card payment details. All payments are made via a secure payment link using a trusted online payment system. Cancelling a Booking
• If you have paid in full, and need to cancel your booking, with less than10 full days notice, prior to arrival you will lose the full payment of your booking
• If you need to cancel your booking with more than before 10 days notice, you would lose 25% of the cost of your booking, and the 75% balance will be kept as a credit, on your account, which can be used towards a future booking.
• As an alternative to cancelling your booking, we are happy to move your booking to alternative dates (as long as there is availability) resulting in no loss of payment. In the event of any increase in cost, we will advise you of this at the time and the difference would be payable via a secure payment link.
• We are unable to offer refunds.

Full refunds can only be made due to exceptional circumstances, and will be at the discretion of Shamrock Car Services and may be offered as credit towards any future booking.

Terms of Contract

The terms of the contract shall be agreed and detailed in your rental contract, should you wish to extend the term of the contract you must notify our office within at least 48 hours of the date of contract expiry, in order for us to authorize the extension, depending on the vehicle’s availability. The cost of the extra days will need to be paid before a new contract can be sent. If you wish to end the contract early, no refund will be issued for the days lost.

Our Vehicles

• All of our vehicles are regularly serviced, repaired, fully insured, taxed and ITV tested, and we ensure they are provided to you in good, working condition.
• TYRES: All of our vehicles will be supplied to you with tyres in good condition. The cost of any repair to or replacement of any tyre(s) is the responsibility of the hirer.
• If a fault is found with the vehicle, or you need help with a damaged tyre, you must notify us immediately (on +34 711 034 812) to ensure we can rectify the problem at the earliest opportunity possible.
• All necessary documents, tools, tyres and accessories are provided within the vehicle stated on the contract. You agree to return the vehicle in the same condition along with all the necessary documents, tools, tyres and accessories provided.
• All of our vehicles provided to you are fully valeted and sanitized. Within the contract, you agree to ensure the vehicle is returned in an acceptable condition. If when your vehicle is returned, needs additional cleaning to our usual standard there may be an additional charge of up to 75€ (depending on severity).
• For the comfort and safety of all of our customers we have a strict non-smoking policy in all of our vehicles. This includes the use of vapes, elf bars and any other breathable substances. On return of the vehicle, should there be obvious use of any of these items (strong smell, ash, cigarette ends, empty elf bars/packets) there is a minimum charge of 50€ to a maximum charge of 200€ for an in depth valet of the vehicle including all air vents after returning the vehicle.

Insurance

All of our vehicles are insured with full Spanish commercial Hire & Reward insurance via Allianz, with breakdown cover and roadside assistance included.

Vehicle Use

The vehicle may only be driven by yourself as authorized in the contract; additional drivers can be added at a cost of €60 as detailed on our booking form. If you intend to or add any additional drivers, we require a copy of their full valid driving license and a copy of their valid passport. Any driver must be over the age of TWENTY-FIVE and held a valid license for a minimum of THREE YEARS. Younger drivers by request only.

The lessee must use the rented vehicle in accordance to the following terms of use:

• No modifications may be made to the structure of the vehicle; Specifically, no roof rack, luggage and/or goods may be attached to the roof.
• The vehicle may not be used to push or tow any other vehicle and/or trailer.
• The vehicle may not be used at sporting events or training sessions of any kind, or car material, accessory or product resistance tests.
• The vehicle and any of its elements or tools may not be transferred, sold, sublet, mortgaged or pledged.
• The vehicle may not be used under the influence of any drugs or alcohol.
• The vehicle may not be driven outside of Spanish mainland territory.
• The milometer may not be manipulated or unsealed and the lessee must notify any damage thereto. Mileage is measured using a milometer or using road maps should this break.
• The lessee must stop and immobilize the vehicle if they detect any fault, or if there is a warning light indicating any malfunction. They must immediately contact Shamrock Car Services or its roadside assistance company.
• The rented vehicle may not be used to transport passengers or goods for commercial or industrial purposes.

ANY BREACH OF THESE TERMS AND CONDITION WILL RESULT IN SHAMROCK CAR SERVICES COLLECTING THE VEHICLE IMMEDIATELY AND ANY MONIES PAID WILL BE LOST.

AMY DAMAGE TO THE VEHICLE AS A RESULT OF BREACHING THESE TERMS AND CONDITIONS, WILL RESULT IN THE INSURANCE COVER BEING INVALID, AND ALL COSTS WILL BE THE RESPONSIBILITY OF THE LESSEE.

Driving Infringements, and Fines

You are responsible for the cost of any and all fines received during the rental period as detailed on your rental contract. We will provide you with a copy of the fine by e-mail and payment will be required within 48 hours in order for us to pay this promptly on your behalf to prevent any increased charges. Under these circumstances, there will also be an admin fee of 25€. If payment is not received within 48 Hours, we will promptly pass your details to Traffico as the named driver for them to deal with you directly.

Fuel Policy

We work on a full-to-full fuel basis, your vehicle will be provided to you with a full tank of fuel and is expected to be returned with a full tank of fuel. We understand that on occasion you may be running late for your flight and not have time to re-fuel, in this event you will be charged for refuelling the vehicle to full, in which we will provide you with a receipt. On the first occasion we will not charge you an admin fee, however if this happens on a regular basis you will be charged an admin fee of 25€ on each subsequent occasion.

In the event you use the wrong fuel when refuelling the vehicle, you must notify us immediately. Using the wrong fuel will incur a minimum charge of 375€ plus the full refuelling of the vehicle.
